Sec. 5585. Acquisition of non-Federal land within Recreation Area

Subject to paragraph (2), the Secretary may acquire non-Federal land within the boundaries of the Recreation Area only through exchange, donation, or purchase from a willing seller. As a further condition on the acquisition of land, the Secretary shall make a determination that the land contains important biological, cultural, historic, or recreational values. Nothing in this part authorizes the use of eminent domain to acquire land or an interest in land. Any land or interest in land acquired by the United States within the boundaries of the Recreation Area shall be— included in the Recreation Area; and administered by the Secretary in accordance with— this part; and other applicable laws (including regulations).
