Chapter 24 of title 10, United States Code, is amended by adding at the end the following new section: Except as provided by subsection (b), beginning 2022, the President shall participate in a large-scale exercise of the nuclear command, control, and communications system during the first year of each term of the President, and may participate in such additional exercises as the President determines appropriate. The President may waive, on a case-by-case basis, the requirement to participate in an exercise under subsection
(a)if the President— determines that participating in such an exercise is infeasible by reason of a war declared by Congress, a national emergency declared by the President or Congress, a public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act ( 42 U.S.C. 247d ), or other similar exigent circumstance; and submits to the congressional defense committees a notice of the waiver and a description of such determination. . The table of sections at the beginning of such chapter is amended by adding at the end the following new item: 499b. Exercises of nuclear command, control, and communications system. .
