Sec. 804. Minimum wage for employees of Department of Defense contractors

Chapter 141 of title 10, United States Code is amended by inserting after section 2402 the following new section: Notwithstanding section 6 of the Fair Labor Standards Act of 1938 ( 29 U.S.C. 206 ), an employee of a Department of Defense contractor performing a covered contract who is paid at an hourly rate shall be paid a minimum wage as follows: Beginning January 30, 2022, $15.00 an hour. Beginning January 1, 2023, at a minimum wage determined annually by the Secretary, except such wage may not be less than $15.00 an hour.
In this section, the term covered contract means a contract or other agreement entered into on or after January 30, 2022, that— is for the procurement of services or construction; and with respect to which wages under such contract or other agreement are subject to— the Fair Labor Standards Act of 1938 ( 29 U.S.C. 201 et seq. ); section 6702 of title 41; or subchapter IV of chapter 31 of title 40 (known as the Davis-Bacon Act ). . The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 2042 the following new item: 2403.
Minimum wage for employees of Department of Defense contractors. . Not later than January 30, 2022, the Secretary of Defense shall issue rules to carry out the requirement of section 2403 of title 10, United States Code, as added by subsection (a).
