Not later than 270 days after the date of the enactment of this Act, the Secretary of Housing and Urban Development shall issue such regulations as may be necessary to establish annual energy efficiency participation incentives consistent with this Act to encourage participants in HUD assistance and lending programs to achieve substantial improvements in energy efficiency. The Secretary shall determine the level of participation incentives based on participants meeting the energy efficiency standards under section 3. The requirement under subsection
(a)for the Secretary to provide annual energy efficiency participation incentives pursuant to the provisions of this Act shall be subject to the annual appropriation of necessary funds.
