Sec. 132. Carbon dioxide sequestration utilities

The Secretary, in collaboration with the Secretary of Transportation and the Administrator of the Environmental Protection Agency, as appropriate, may provide technical assistance to a State that is seeking to— establish a government-owned carbon dioxide sequestration utility; or regulate a privately owned carbon dioxide sequestration utility. Technical assistance provided under subsection
(a)may include— with respect to a government-owned carbon dioxide sequestration utility— conducting engineering studies to support the development of a carbon dioxide sequestration facility; and identifying potential carbon dioxide transportation routes; and with respect to State regulation of a privately owned carbon dioxide sequestration utility— helping with developing regulations for any privately owned carbon dioxide sequestration utility, including with respect to the development of a permitting system; and assisting with developing regulations for— services provided by a privately owned carbon dioxide sequestration utility; and the setting of rates charged for such services. Not later than 1 year after the date of enactment of this section, the Secretary shall submit to Congress a report that— characterizes Federal, State, and local regulations that apply to the development and operation of carbon dioxide transportation infrastructure and sequestration facilities; identifies any gaps in applicable regulations that need to be addressed to ensure the safe and effective operation of carbon dioxide transportation infrastructure and sequestration facilities; evaluates whether regulation of the rates and terms of service for carbon dioxide transportation service or sequestration service is necessary to ensure fair access to such services; evaluates whether the use of the right of eminent domain to develop carbon dioxide transportation infrastructure and sequestration facilities is consistent with the public interest; and provides any recommended changes to Federal law that would support the development and use of carbon dioxide transportation infrastructure and sequestration facilities consistent with the public interest. The term carbon dioxide sequestration utility means any organization that provides carbon dioxide transportation or sequestration service.
