Not later than 2 years after the date of enactment of this Act, the Secretary of Transportation, in consultation with the heads of appropriate Federal agencies, State highway safety offices, State toxicologists, traffic safety advocates, and other interested parties, shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that, using the National Safety Council model guidelines for toxicology testing— identifies any barriers that States encounter in submitting the alcohol and drug toxicology results to the Fatality Analysis Reporting System; provides recommendations on how to address any barriers identified under paragraph (1); provides further steps that the Secretary, acting through the Administrator of the National Highway Traffic Safety Administration, shall take to assist States in improving— toxicology testing in cases of motor vehicle crashes; and the reporting of alcohol and drug toxicology results in cases of motor vehicle crashes.
