Of the funds appropriated by this Act under the headings Economic Support Fund , International Narcotics Control and Law Enforcement , Nonproliferation, Anti-terrorism, Demining and Related Programs , Peacekeeping Operations , and Foreign Military Financing Program , not less than $135,000,000 shall be made available for the Prevention and Stabilization Fund for the purposes enumerated in section 509(a) of the Global Fragility Act of 2019 (title V of division J of Public Law 116–94 ), of which $25,000,000 may be made available for the Multi-Donor Global Fragility Fund authorized by section 510(c) of such Act:
That such funds shall be allocated as specified under this section in the explanatory statement described in section 4 (in the matter preceding division A of this consolidated Act): Provided, That funds appropriated under such headings may be transferred to, and merged with, funds appropriated under such headings for such purposes: Provided further, That such transfer authority is in addition to any other transfer authority provided by this Act or any other Act, and is subject to prior consultation with, and the regular notification procedures of, the Committees on Appropriations:
Provided further, That funds made available pursuant to this subsection that are transferred to funds appropriated under the heading Provided further, Foreign Military Financing Program may remain available until September 30, 2024. Of the funds appropriated by this Act under the headings Economic Support Fund and International Narcotics Control and Law Enforcement , not less than $10,000,000 shall be made available for programs to promote accountability for genocide, crimes against humanity, and war crimes, which shall be in addition to any other funds made available by this Act for such purposes:
That such programs shall include components to develop local investigative and judicial skills, and to collect and preserve evidence and maintain the chain of custody of evidence, including for use in prosecutions, and may include the establishment of, and assistance for, transitional justice mechanisms: Provided, That such funds shall be administered by the Ambassador-at-Large for the Office of Global Criminal Justice, Department of State, and shall be subject to prior consultation with the Committees on Appropriations:
Provided further, That funds made available by this paragraph shall be made available on an open and competitive basis. Provided further, Funds appropriated by this Act and prior Acts making appropriations for the Department of State, foreign operations, and related programs under the heading Economic Support Fund may be made available to the Global Community Engagement and Resilience Fund, including as a contribution.
