The Administrator of the Environmental Protection Agency shall take final action on a petition for approval of a renewable fuel pathway under the renewable fuel program under section 211(o) of the Clean Air Act ( 42 U.S.C. 7545(o) ) if— 90 days or more has passed since the petition was submitted to the Administrator; and the combination of the fuel type, production process, and feedstock that is described in the petition has been approved for sale in at least one State under a program designed to reduce the carbon intensity of transportation fuel.
