Section 501(b)(1) of title 40, United States Code, is amended by striking subparagraph
(B)and inserting the following: A contract under this paragraph to purchase electricity produced by a public utility using zero-emission technology may be made for a period of not more than 40 years. A contract under this paragraph for a public utility service other than a service described in subclause
(I)may be made for a period of not more than 10 years. The cost of a contract under this paragraph for any fiscal year may be paid from the appropriations for that fiscal year. In this subparagraph, the term zero-emission technology means a generator that uses a technology or combination of technologies that— has a carbon intensity of zero; and is placed into service after the date of enactment of the CLEAN Future Act . .
