Section 210 of the Public Utility Regulatory Policies Act of 1978 ( 16 U.S.C. 824a–3 ) is amended by adding at the end the following: The Commission shall require that qualifying facilities have the option to enter a fixed price contract whose term is at least as long as the term on which the incumbent utility recovers invests in new generation, whether self-built or in the form of a long-term power purchase agreement. .
