Clause
(iii)of section 432(f)(9)(D) of the Internal Revenue Code of 1986, as redesignated by section 211(a) and as in effect before the amendments made by section 211 other than subsection
(a)thereof, is amended to read as follows: No benefits based on disability (as defined under the plan) may be suspended under this paragraph if the participant or beneficiary is disabled (as so defined) or receiving disability benefits under the plan as of the date of the suspension of benefits. No benefits under the plan may be suspended under this paragraph of any participant or beneficiary who is entitled to a benefit under title II of the Social Security Act on the basis of a disability (as defined in section 223(d)(2) of such Act) as of such date. . (iii)of section 305(f)(9)(D) of the Employee Retirement Income Security Act of 1974 ( 29 U.S.C. 1085(f)(9)(D) ), as redesignated by section 212(a) and as in effect before the amendments made by section 212 other than subsection
(a)thereof, is amended to read as follows: No benefits based on disability (as defined under the plan) may be suspended under this paragraph if the participant or beneficiary is disabled (as so defined) or receiving disability benefits under the plan as of the date of the suspension of benefits. No benefits under the plan may be suspended under this paragraph of any participant or beneficiary who is entitled to a benefit under title II of the Social Security Act on the basis of a disability (as defined in section 223(d)(2) of such Act) as of such date. . The amendments made by this section shall apply to suspensions of benefits taking effect after the date of the enactment of this Act.
