Section 454 of the Social Security Act ( 42 U.S.C. 654 ) is amended— by striking and at the end of paragraph (33); by striking the period at the end of paragraph
(34)and inserting ; and ; and by inserting after paragraph
(34)the following: provide that the State shall not use the State program operated under this part to collect any amount owed to the State by reason of costs incurred under the State plan approved under title XIX for the birth of a child for whom support rights have been assigned pursuant to section 1912. . Section 1902(a)(25)(F) of the Social Security Act ( 42 U.S.C. 1396a(a)(25)(F) ) is amended— in clause (i), by striking care.; and inserting care; and ; and in clause (ii), by inserting only if such third-party liability is derived through insurance, before seek . Except as provided in paragraph (2), the amendments made by this section take effect on October 1, 2025. A State may elect for the amendments made by this section to take effect with respect to the State plans under part D of title IV and title XIX of the Social Security Act ( 42 U.S.C. 671 et seq.; 1396 et seq.) on the first day of any quarter of fiscal years 2021 through 2025.
