Sec. 7003. Strengthening the Strategic National Stockpile

Section 319F–2 of the Public Health Service Act ( 42 U.S.C. 247d–6b ) is amended— in subsection (a)— in paragraph (2)(A), by adding and the contracts issued under paragraph
(5)after paragraph
(1)in paragraph (3)(F), by striking Secretary of Homeland Security and inserting Secretary of Health and Human Services, in coordination with or at the request of, the Secretary of Homeland Security, ; by redesignating paragraph
(5)as paragraph (6); by inserting after paragraph
(4)the following: The Secretary, in maintaining the stockpile under paragraph
(1)and carrying out procedures under paragraph (3), may— enter into contracts or cooperative agreements with vendors for procurement, maintenance, and storage of reserve amounts of drugs, vaccines and other biological products, medical devices, and other medical supplies (including personal protective equipment, ancillary medical supplies, and other applicable supplies required for the administration of drugs, vaccines and other biological products, medical devices, and diagnostic tests in the stockpile), under such terms and conditions (including quantity, production schedule, maintenance costs, and price of product) as the Secretary may specify, including for purposes of— maintenance and storage of reserve amounts of products intended to be delivered to the ownership of the Federal Government under the contract, which may consider costs of shipping, or otherwise transporting, handling, storage, and related costs for such product or products; and maintaining domestic manufacturing capacity of such products to ensure additional reserved production capacity of such products is available, and that such products are provided in a timely manner, to be delivered to the ownership of the Federal Government under the contract and deployed in the event that the Secretary determines that there is a need to quickly purchase additional quantities of such product; and promulgate such regulations as the Secretary determines necessary to implement this paragraph. ; and in subparagraph
(A)of paragraph (6), as so redesignated— in clause (viii), by striking ; and and inserting a semicolon; in clause (ix), by striking the period and inserting ; and ; and by adding at the end the following: an assessment of the contracts or cooperative agreements entered into pursuant to paragraph (5). ; and in subsection (c)(2)(C), by striking on an annual basis and inserting not later than March 15 of each year .
