Section 181(a) of the Trade Act of 1974 ( 19 U.S.C. 2241(a) ) is amended— by redesignating paragraph
(4)as paragraph (5); and by inserting after paragraph
(3)the following: For calendar year 2021 and each succeeding calendar year, the Trade Representative shall include in the analyses and estimates under paragraph
(1)an identification and analysis of any laws, policies, or practices of a foreign country that are market-distorting so as to potentially harm competition in the United States and violate antitrust laws of the United States. In each report required by subsection (b), the Trade Representative shall include a description and estimate of the impact of each law, policy, or practice identified under subparagraph
(A)on United States commerce. The Trade Representative shall provide a list of the laws, policies, and practices identified under subparagraph (A), and any supporting information, to the Attorney General and the Federal Trade Commission to develop policy and research tools to promote competition and inform the enforcement of antitrust laws. .
