Sec. 416. Reports on agreements to resolve disputes under section 301 of the Trade Act of 1974

Section 301 of the Trade Act of 1974 ( 19 U.S.C. 2411 ) is amended by adding at the end the following: Not later than 90 days after the date of the enactment of this subsection, and every 90 days thereafter, the United States International Trade Commission shall submit to the Committee on Finance of the Senate, the Committee on Ways and Means of the House of Representatives, and the President a report on the compliance of the People’s Republic of China with each provision of— the Economic and Trade Agreement Between the Government of the United States of America and the Government of China, dated January 15, 2020 (commonly referred to as the Phase I Trade Deal ); and any other agreement entered into with the People’s Republic of China to resolve a dispute relating to a matter under investigation under this title.
Not later than 180 days after the United States enters into any agreement with a foreign country to settle or resolve a trade dispute relating to a matter under investigation under this title, the United States International Trade Commission shall submit to the Committee on Finance of the Senate, the Committee on Ways and Means of the House of Representatives, and the President a report assessing— whether the parties to the agreement are complying with the agreement; and whether the agreement is effective at resolving the dispute.
If the Commission determines under subparagraph (A)(ii) that an agreement is not effective at resolving a dispute described in subparagraph (A), the Commission shall review the matter and submit to the Committee on Finance of the Senate, the Committee on Ways and Means of the House of Representatives, and the President a report on the matter every 180 days after that determination until the matter is resolved. .
