An individual shall be eligible to enroll in the health plan if such individual, for the entire period for which enrollment is sought— is a qualified individual within the meaning of section 1312 of the Patient Protection and Affordable Care Act ( 42 U.S.C. 18032 ); is not eligible for benefits under the Medicare program under title XVIII of the Social Security Act ( 42 U.S.C. 1395 et seq.); and is not otherwise eligible for, or has been otherwise offered, employer-sponsored health care coverage. The health plan shall be made available through the Exchanges, including the Small Business Health Options Program Exchange.
