Section 402(i)(3) of the Surface Mining Control and Reclamation Act of 1977 ( 30 U.S.C. 1232(i)(3) ) is amended by adding at the end the following: Subparagraph

(B)shall not apply to transfers to the Secretary of the Interior for distribution to States and Indian tribes under paragraph (2). .
