In this Act: The term COVID–19 emergency means the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act ( 42 U.S.C. 247d ) on January 31, 2020, with respect to COVID–19. The term donation period means the period— beginning on January 31, 2020; and ending on the later of— December 31, 2020; and a date after December 31, 2020, if there are remaining food surpluses relating to the COVID–19 emergency, as determined by the Secretary. The term Secretary means the Secretary of Agriculture.
