Sec. 1080. Disposal of dredged materials

Not later than 180 days after the date of enactment of this Act, the Secretary shall amend parts 335 through 338 of title 33, Code of Federal Regulations, to ensure that, when evaluating the placement of dredged materials from operation and maintenance of water resources development projects, the Corps of Engineers shall consider— the suitability of the material to be dredged for a full range of beneficial uses; and the economic and environmental benefits and impacts, and feasibility, of using the material for those beneficial uses.
Nothing in this section affects, preempts, or interferes with any obligation to comply with the provisions of any Federal environmental law, including— the National Environmental Policy Act of 1969 ( 42 U.S.C. 4321 et seq.); the Federal Water Pollution Control Act ( 33 U.S.C. 1251 et seq.); and the Endangered Species Act of 1973 ( 16 U.S.C. 1531 et seq.).
