Sec. 1032. Conveyance of certain Federal land to the city of Montgomery, Alabama

In this section: The term City means the city of Montgomery, Alabama. The term Federal land means the 62.38 acres of land and water under the primary jurisdiction of the Secretary in the R.E. Bob Woodruff Project Area that is covered by lease number DACW01–1–05–0037, including the parcels and structure known as Powder Magazine , which is a National Historic Site. To the extent practicable, not later than 180 days after the date of enactment of this Act, the Secretary shall, on request of the City, convey to the City all right, title, and interest of the United States in and to the Federal land.
If the Secretary of the Interior determines that any portion of the Federal land is suitable and desirable for use as a historic monument, the Secretary may convey such portion of the Federal land to the City, without monetary consideration, in accordance with section 550(h) of title 40, United States Code. The Secretary shall convey any portion of the Federal land not conveyed under subsection (c)— by quitclaim deed; and subject to terms and conditions that area mutually satisfactory to the Secretary and the City, including such additional terms and conditions as the Secretary considers appropriate— to protect the interests of the United States, such as any required easements; to protect and maintain the National Historic Site described in subsection (a)(2), in accordance with applicable law; and to preserve public access to the Federal land.
As consideration for a conveyance under subsection (d), the City shall pay to the Secretary an amount that is not less than the fair market value of the Federal land, as determined by the Secretary. The Secretary shall require the City to pay the costs incurred by the Secretary after the date of enactment of this Act relating to any conveyance of the Federal land under this section, including— survey costs; costs relating to environmental documentation; and any other administrative costs relating to the conveyance.
If the Secretary collects amounts from the City under paragraph
(1)before the costs are actually incurred and those amounts exceed the costs actually incurred by the Secretary in carrying out the conveyance, the Secretary shall refund the excess amounts to the City. Amounts received by the Secretary as reimbursement under paragraph
(1)shall be— credited to, and merged with amounts in, the fund or account that was used to cover the costs incurred by the Secretary; and available for the same purposes, and subject to the same conditions and limitations, as amounts in the fund or account to which the amounts are credited under subparagraph (A). The City shall hold the United States harmless from any liability with respect to activities carried out on the Federal land on or after the date of conveyance of the Federal land.
