Sediment fill in the Wilmington Harbor South Disposal Area confined disposal facility, Delaware, shall not be more than 45 feet. Until the conveyance under subsection
(c)is completed, the Wilmington Harbor South Disposal Area confined disposal facility, Delaware, shall be used for the purposes of— a dredge disposal facility for the Port of Edgemoor; and other uses, as determined by the State of Delaware. As soon as practicable after sediment fill in the Wilmington Harbor South Disposal Area confined disposal facility, Delaware, reaches 45 feet, the Secretary shall complete the conveyance of nonusable land at the Wilmington Harbor South Disposal Area confined disposal facility, Delaware, to the State of Delaware for fair market value.
