Section 534 of title 28, United States Code, is amended— in subsection (a)— in paragraph (3), by striking and at the end; by redesignating paragraph
(4)as paragraph (5); and by inserting after paragraph
(3)the following: acquire, collect, classify, and preserve records from Federal, tribal, and State courts and other agencies identifying individuals subject to extreme risk protection orders, as defined in section 401 of the Gun Violence Prevention and Community Safety Act of 2020 , provided that such records shall be destroyed if the orders expire or are terminated or dissolved; and ; in subsection (b), by striking (a)(4) and inserting (a)(5) ; and by adding at the end the following: Federal, tribal, and State criminal justice agencies and criminal and civil courts may— include extreme risk protection orders, as defined in section 401 of the Gun Violence Prevention and Community Safety Act of 2020 , in national crime information databases, as defined in subsection (f)(3) of this section; and have access to information regarding extreme risk protection orders through the national crime information databases, as defined in subsection (f)(3) of this section. .
