Section 301 of the Trade Agreements Act of 1979 ( 19 U.S.C. 2511 ) is amended— in subsection (b)(1), by striking the North American Free Trade Agreement and inserting the USMCA (as defined in section 3 of the ; and United States-Mexico-Canada Agreement Implementation Act ) in subsection (e)— by striking Annex 1001.1a–2 of the North American Free Trade Agreement and inserting Annex 13–A of the USMCA (as defined in section 3 of the ; and United States-Mexico-Canada Agreement Implementation Act ) by striking chapter 10 of such Agreement and inserting chapter 13 of the USMCA .
Section 308(4)(A)(ii) of the Trade Agreements Act of 1979 ( 19 U.S.C. 2518(4)(A)(ii) ) is amended— by striking a party to the North American Free Trade Agreement, and inserting Mexico, as a party to the USMCA (as defined in section 3 of the ; and United States-Mexico-Canada Agreement Implementation Act ), by striking the North American Free Trade Agreement for and inserting the USMCA for . The amendments made by subsections
(a)and
(b)shall— take effect on the date on which the USMCA enters into force; and apply with respect to a procurement on or after that date. In the case of a procurement before the date on which the USMCA enters into force— the amendments made by subsections
(a)and
(b)to sections 301 and 308 of the Trade Agreements Act of 1979 ( 19 U.S.C. 2511 and 2518) shall not apply with respect to the contract; and sections 301 and 308 of such Act, as in effect on the day before that date, shall continue to apply on and after that date with respect to the contract.
