In this section: The term covered database means— the database of the National Crime Information Center; the Combined DNA Index System; the Next Generation Identification System; and any other database or system of a law enforcement agency under which a report of a missing Indian or murdered Indian may be submitted, including— the Violent Criminal Apprehension Program; and the National Missing and Unidentified Persons System. The term death investigation has the meaning determined by the Attorney General.
The term Indian has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act ( 25 U.S.C. 5304 ). The term Indian lands has the meaning given the term in section 3 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 ( 25 U.S.C. 4302 ). The term Indian tribe has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act ( 25 U.S.C. 5304 ). The term missing has the meaning determined by the Attorney General.
The term notification system means— the Criminal Justice Information Network; the AMBER Alert communications network established under subtitle A of title III of the PROTECT Act ( 34 U.S.C. 20501 et seq.); and any other system or public notification system that relates to a report of a missing or murdered Indian, including any Federal, State, local, or Tribal notification system. The term sexual assault has the meaning determined by the Attorney General. The term special case of interest to Indian tribes means a case involving— a missing Indian; a missing person whose last known location is believed to be on, in, or near Indian lands; death investigation of an Indian; death investigation of a person found on, in, or near Indian lands; sexual assault of an Indian; or sexual assault on, in, or near Indian lands.
Beginning in the first fiscal year after the date of enactment of this Act, and annually thereafter, the Attorney General shall include in the annual report submitted to Congress under section 10(b) of the Indian Law Enforcement Reform Act ( 25 U.S.C. 2809(b) )— a summary of known statistics relating to special cases of interest to Indian tribes investigated by the law enforcement agencies of the Department of Justice or reported in the National Missing and Unidentified Persons System; and recommendations regarding methods to improve collection of the data relating to special cases of interest to Indian tribes.
To the maximum extent practicable, the information submitted under paragraph
(1)shall maintain victim privacy by excluding information that can be used, together with the information alone or in conjunction with other information— to identify, contact, or locate an individual; or to identify an individual in context. The Attorney General shall ensure that the statistics described in paragraph (1)(A) reflect variations and trends in— age; gender; Tribal enrollment and affiliation, if available; and any other variation or trend that the Attorney General determines to be appropriate. Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Indian Affairs and the Committee on the Judiciary of the Senate and the Committee on the Judiciary and the Committee on Natural Resources of the House of Representatives a comprehensive report that includes— a review of— Federal, State, local, and Tribal law enforcement agency jurisdiction, including— the facts that determine which law enforcement agency has jurisdiction over a case; and interjurisdictional coordination best practices; the response policies and procedures with respect to a report of a missing Indian or murdered Indian of— the Federal Bureau of Investigation; the Bureau of Indian Affairs; and any other Federal law enforcement agency responsible for responding to, or investigating, a report of a missing Indian or murdered Indian; the covered databases relating to special cases of interest to Indian tribes; the requirements for reporting information that is specific to special cases of interest to Indian tribes in covered databases; the impact that staffing levels may have on the effectiveness of the response of law enforcement to special cases of interest to Indian tribes; and notification systems relating to special cases of interest to Indian tribes, including notification systems used to alert— other law enforcement agencies; and the public; and recommendations for improving— the policies of the Federal Bureau of Investigation, the Bureau of Indian Affairs, and other Federal law enforcement agencies for investigating and reporting missing Indians and murdered Indians; coordination in response to special cases of interest to Indian tribes between and among— Federal law enforcement agencies; and other Federal law enforcement agencies; and State, local, and Tribal law enforcement agencies; Tribal access to covered databases; and technical assistance to Indian tribes for covered database access and use. Beginning in the first calendar year beginning after the date of enactment of this Act, and annually thereafter, the Federal Bureau of Investigation shall include gender in the annual statistics relating to missing and unidentified persons published on the public website of the Federal Bureau of Investigation.
