Nothing in this subtitle limits the eligibility of an individual or entity to receive assistance made available under a covered infrastructure program if the individual or entity is prevented, in whole or in part, from complying with section 122(a) or 123(a), as applicable, because a Federal court issues a final order in which the court finds that a requirement or the implementation of section 122(a) or 123(a), as applicable, is unconstitutional.
