Section 60302(c) of title 49, United States Code, is amended— in paragraph (2)— in subparagraph (A), by striking and at the end; in subparagraph (B)— by striking the amount of the fee ; and by striking the period at the end and inserting ; and ; and by adding at the end the following: may only be used to the extent provided in advance in an appropriations Act. ; by striking paragraph (3); and by adding at the end the following: The amount of a fee imposed under subsection
(a)shall be sufficient to pay the costs of activities referred to in subsection (c), subject to the limitation that the total amount of fees collected for a fiscal year under subsection
(b)may not be more than 105 percent of the total amount of the appropriations made for the fiscal year for activities to be financed by the fees. .
