Sec. 151. Limitation on availability of funds for communications systems lacking certain resiliency features

Except as provided under subsection (b), none of the funds authorized to be appropriated by this Act or otherwise made available for the Department of Defense for fiscal year 2020 may be used for the procurement of a current or future Department of Defense communication program of record unless the communications equipment— provides the ability to deny geolocation of a transmission that would allow enemy targeting of the force; provides the ability to securely communicate classified information in a jamming environment of like-echelon forces; and utilizes a waveform that is made available in the Department of Defense Waveform Information Repository.
The Secretary of a military department may waive the requirement under subsection
(a)with respect to a communications system upon certifying to the congressional defense committees that the system will not require resiliency due to its expected use.
