Section 401 of the Help America Vote Act of 2002 ( 52 U.S.C. 21111 ), as amended by section 3(b), is amended— by striking The Attorney General and inserting
(a); and In General.— The Attorney General by adding at the end the following new subsections: Any person who is aggrieved by a violation of section 301 or 303A which has occurred, is occurring, or is about to occur after the date that is 6 years after the date of the enactment of the Protecting American Votes and Elections Act of 2019 may file an action under section 1979 of the Revised Statutes of the United States ( 42 U.S.C. 1983 ) to enforce the requirements under such section. Nothing in this section may be construed to affect the availability of the State-based administrative complaint procedures required under section 402 to any person filing a complaint under this subsection. . Section 292(a) of the Help America Vote Act of 2002 ( 52 U.S.C. 21062(a) ) is amended by striking ; except that and all that follows and inserting a period.
