Chapter 47 of title 18, United States Code, is amended by adding at the end the following: It shall be unlawful for a person to obtain custody of an unaccompanied alien child (as defined in section 462(g) of the Homeland Security Act of 2002 ( 6 U.S.C. 279(g) ))— by making any materially false, fictitious, or fraudulent statement or representation; or by making or using any false writing or document with the knowledge that such writing or document contains any materially false, fictitious, or fraudulent statement or entry. Any person who violates, or attempts or conspires to violate, subsection
(a)shall be fined under this title and imprisoned for not less than 1 year. If the primary purpose of a violation, attempted violation, or conspiracy to violate this section was to subject the child to sexually explicit activity or any other form of exploitation, the offender shall be fined under this title and imprisoned for not less than 15 years. .
