Sec. 706. Securing critical supplies

Not later than 180 days after the date of the enactment of this Act, the Secretary, acting through the Under Secretary and the Director, shall— identify items determined by the Secretary to be critical to survival during a crisis resulting from a terrorist attack, pandemic, or natural disaster; assess the activities of the Department with respect to the prevention of a shortage of items; assess vulnerabilities in the supply chain for such items, which vulnerabilities may be exploited by individuals, entities, or foreign terrorist organizations that may have an adversarial relationship with the United States; and develop and submit to the appropriate congressional committees a— report containing a strategy to prevent such a shortage based upon the assessments required under paragraph (2); and classified annex to the report required under subparagraph
(A)relating to a strategy to prevent the exploitation of vulnerabilities in the supply chain for such items based upon the assessment required under paragraph (3). The strategies required under subsection
(a)shall include— an identification of items that the Secretary determines to be critical to survival, including— food and water; prescription medication; medical supplies; and energy infrastructure and supplies; an examination of whether the source of any such item is foreign-owned, controlled, or influenced by a country that may have an adversarial relationship with the United States; and recommendations with respect to steps the Department could take to— ensure the availability of such items; and safeguard from exploitation by individuals, entities, or foreign terrorist organizations the supply chain for such items. In this section: The term appropriate congressional committees means— the Committee on Homeland Security of the House of Representatives; and the Committee on Homeland Security and Governmental Affairs of the Senate. The term Department means the Department of Homeland Security. The term Director means the Director of the Cybersecurity and Infrastructure Security Agency of the Department of Homeland Security. The term Secretary means the Secretary of Homeland Security. The term Under Secretary means the Under Secretary of Intelligence and Analysis of the Department of Homeland Security.
