Section 122 of the Workforce Innovation and Opportunity Act ( 29 U.S.C. 3152 ) is amended— in subsection (a)(3), by adding at the end the following: A provider of qualified online training services shall be included and maintained on the list of eligible providers of training services described in subsection
(d)so long as such provider complies with the criteria, information requirements, and procedures established under this section. ; and in subsection (b), by adding at the end the following: In establishing criteria, information requirements, or procedures under this section, a Governor, State board, or local board may not require a provider of qualified online training services, in providing such qualified online training services, to— maintain a physical presence in a State or local area; or in the case of a provider that is an organization described in section 501(c) of the Internal Revenue Code and is exempt from taxation under section 501(a) of such Code, be a provider described in subsection (a)(2). In this subsection, the term qualified online training services means training services that— are provided over the internet or through other forms of electronic communication; and lead to a recognized postsecondary credential. .
