None of the funds made available by this Act may be used to destroy, or to implement a policy or practice that permits the destruction of, any document, recording, or other record pertaining to any— death of, potential sexual assault or abuse perpetrated against, or allegation of abuse, criminal activity, or disruption committed by, an individual held in the custody of the Department of Homeland Security. The records referred to in subsection
(a)shall be made available to an individual who has been charged with a crime, been placed into segregation, or otherwise punished as a result of an allegation described in paragraph (3), upon the request of such individual.
