None of the funds made available by this Act may be used by the Department of Justice to argue, in the conduct of any litigation to which the United States, or an agency or officer thereof is a party, that any provision of the Patient Protection and Affordable Care Act ( Public Law 111–148 ; 124 Stat. 119) or of the Health Care and Education Reconciliation Act of 2010 ( Public Law 111–152 ), is unconstitutional or is invalid or unenforceable on any ground, including that certain provisions of the Patient Protection and Affordable Care Act are not severable from section 5000A of that Act.
