Section 5(a)(2)(B) of the Act of August 18, 1941 ( 33 U.S.C. 701n(a)(2)(B) ) is amended— in clause (i)(I), by inserting , or provide contributions equal to, after pay ; and in clause (ii)— in the heading, by inserting after and contributions ; of payments by inserting or contributions after Non-Federal payments ; and by inserting or contributions after non-Federal payments . Section 1161(b) of the Water Resources Development Act of 2018 ( 33 U.S.C. 701n note) is amended— in the matter preceding paragraph (1)— by striking the three fiscal years preceding and inserting five fiscal years preceding ; and by striking last day of the third fiscal year and inserting last day of the fifth fiscal year ; in paragraph (1), by inserting , or provide contributions equal to, before an amount sufficient ; and by striking paragraph
(2)and inserting the following: the Secretary determines that the damage to the structure was not as a result of negligent operation or maintenance. .
