Sec. 22005. Highway safety grants emergency authority

The Secretary of Transportation (referred to in this section as the Secretary ) may waive or postpone any requirement under section 402, 404, 405, or 412 of title 23, United States Code, section 4001 of the FAST Act ( Public Law 114–94 ; 129 Stat. 1497), or part 1300 of title 23, Code of Federal Regulations (or successor regulations), if the Secretary determines that— the Coronavirus Disease 2019 (COVID–19) is having a substantial impact on— the ability of States to implement or carry out any grant, campaign, or program under those provisions; or the ability of the Secretary to carry out any responsibility of the Secretary with respect to a grant, campaign, or program under those provisions; or the requirements of those provisions are having a substantial impact on the ability of States or the Secretary to address the Coronavirus Disease 2019 (COVID–19).
The Secretary shall periodically submit to the relevant committees of Congress a report describing— each determination made by the Secretary under subsection (a); and each waiver or postponement of a requirement under that subsection. The amount provided by this section is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.
