In addition to any other duty, there is imposed a duty on drugs which are being imported or offered for import into the United States (within the meaning of section 801 of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 381(a) )) from the People’s Republic of China. The rate of duty imposed by paragraph
(1)shall be 25 percent ad valorem. In addition to any other duty, there is imposed a duty on drugs which are being imported or offered for import into the United States (within the meaning of section 801 of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 381(a) )) from the Republic of India. The rate of duty imposed by paragraph
(1)shall be 20 percent ad valorem. In addition to any other duty, there is imposed a duty on drugs which are being imported or offered for import into the United States (within the meaning of section 801 of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 381(a) )) from any foreign country other than the People’s Republic of China or the Republic of India. Except as provided in subparagraph (B), the rate of duty imposed by paragraph
(1)shall be 10 percent ad valorem. In the case of a drug that includes one or more active pharmaceutical ingredients originating from the People’s Republic of China or the Republic of India, the rate of duty imposed by paragraph
(1)shall be— 25 percent ad valorem for those containing an active pharmaceutical ingredient from China; and 20 percent ad valorem for those containing an active pharmaceutical ingredient from India. The provisions of this section shall apply to articles described in subsections (a), (b), and
(c)entered, or withdrawn from warehouse for consumption, on or after the date that is 15 days after the date of the enactment of this Act.
