Except to the extent that any provision of the agreement conflicts with this Act, Congress approves, ratifies, and confirms the agreement (including any amendments to the agreement that are executed to make the agreement consistent with this Act). The Secretary is authorized and directed to promptly execute the agreement to the extent that the agreement does not conflict with this Act, including— any exhibits to the agreement requiring the signature of the Secretary; and any amendments to the agreement necessary to make the agreement consistent with this Act.
In implementing the agreement and this Act, the Secretary shall comply with all applicable provisions of— the Endangered Species Act of 1973 ( 16 U.S.C. 1531 et seq.); the National Environmental Policy Act of 1969 ( 42 U.S.C. 4321 et seq.); and all other applicable environmental laws and regulations. Execution of the agreement by the Secretary as provided for in this Act shall not constitute a major Federal action under the National Environmental Policy Act of 1969 ( 42 U.S.C. 4321 et seq.).
