Sec. 614. Payment of hazardous duty incentive pay for members of the uniformed services

Section 351 of title 37, United States Code, is amended— in subsection (c)(2)— in subparagraph (A)(i), by striking shall and inserting may ; in subparagraph (B)— by striking paragraph
(2)or
(3)and inserting paragraph
(2); by striking the Secretary concerned may prorate and all that follows and inserting the Secretary concerned— ; and by adding at the end the following: may prorate the payment amount to reflect the duration of the member's actual qualifying service during the month; and in the case of member who performs hazardous duty specifically designated by the Secretary concerned, shall pay the member hazardous duty pay in an amount not to exceed the maximum amount of hazardous duty pay that would be payable to the member under subsection (b)(2) for the entire month, regardless of the duration of the qualifying service. In the case of hazardous duty pay payable under paragraph
(3)of subsection (a), the Secretary concerned may prorate the payment amount to reflect the duration of the member's actual qualifying service during the month. ; and in subsection (h), by striking December 31, 2020 and inserting December 31, 2021 .
