In this division: The term Bank Secrecy Act means— section 21 of the Federal Deposit Insurance Act ( 12 U.S.C. 1829b ); chapter 2 of title I of Public Law 91–508 ( 12 U.S.C. 1951 et seq.); and subchapter II of chapter 53 of title 31, United States Code. The term electronic fund transfer has the meaning given the term in section 903 of the Electronic Fund Transfer Act ( 15 U.S.C. 1693a ). The term Federal functional regulator — has the meaning given the term in section 509 of the Gramm-Leach-Bliley Act ( 15 U.S.C. 6809 ); and includes any Federal regulator that examines a financial institution for compliance with the Bank Secrecy Act.
The term financial agency has the meaning given the term in section 5312(a) of title 31, United States Code, as amended by section 6102 of this division. The term financial institution — has the meaning given the term in section 5312 of title 31, United States Code; and includes— an electronic fund transfer network; and a clearing and settlement system. The term FinCEN means the Financial Crimes Enforcement Network of the Department of the Treasury. The term Secretary means the Secretary of the Treasury.
The term State bank supervisor has the meaning given the term in section 3 of the Federal Deposit Insurance Act ( 12 U.S.C. 1813 ). The term State credit union supervisor means a State official described in section 107A(e) of the Federal Credit Union Act ( 12 U.S.C. 1757a(e) ).
