Section 2688(d)(2) of title 10, United States Code, is amended— in the first sentence, by inserting or the renewal of such a contract after paragraph
(1); in the second sentence, by striking the contract. and inserting the contract or contract renewal. ; and by adding at the end the following new sentence: A renewal of a contract pursuant to this paragraph may be entered into only within the last five years of the existing contract term. . Section 2914 of title 10, United States Code, as amended by section 2805, is further amended— by redesignating subsection
(c)as subsection (d); and by inserting after subsection
(b)the following new subsection (c): A project under this section may include— activities related to a utility system authorized under subsections (h), (j), and
(k)of section 2688 or section 2913 of this title, notwithstanding that the United States does not own the utility system covered by the project; and energy-related activities included as a separate requirement in an energy savings performance contract (as defined in section 804(3) of the National Energy Conservation Policy Act ( 42 U.S.C. 8287c(3) )). .
