Sec. 824. Preference for sourcing rare earth materials from the national technology and industrial base

The Secretary of Defense shall, to the maximum extent practicable, acquire materials that are determined to be strategic and critical materials required to meet the defense, industrial, and essential civilian needs of the United States in the following order of preference: From sources located within the United States. From sources located within the national technology and industrial base (as defined in section 2500 of title 10, United States Code). From other sources as appropriate.
Not later than 180 days after the date of the enactment of this Act, the Under Secretary of Defense for Acquisition and Sustainment, in consultation with the Under Secretary of Defense (Comptroller), the Vice Chairman of the Joint Chiefs of Staff, and the appropriate Under Secretary of State, as designated by the Secretary of State, shall issue guidance to ensure the elimination of the dependency of the United States on rare earth materials from China by fiscal year 2035.
