Sec. 231. Limitation on availability of funds pending review and report on next generation air dominance capabilities

Of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2021 for the next generation air dominance initiative of the Air Force, not more than 85 percent may be obligated or expended until the date on which the Director of Cost Assessment and Program Evaluation submits the report required under subsection (d)(1). Of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2021 for the next generation air dominance initiative of the Navy, not more than 85 percent may be obligated or expended until the date on which the Director of Cost Assessment and Program Evaluation submits the report required under subsection (d)(2).
The Director of Cost Assessment and Program Evaluation shall conduct— a non-advocate review of the next generation air dominance initiative of the Air Force; and a non-advocate review of the next generation air dominance initiative of the Navy. Each review under paragraph
(1)shall include an assessment of— all risks associated with cost, schedule, development, integration, production, fielding, and sustainment of next generation air dominance capabilities; the technological maturity of significant hardware and software efforts planned or carried out as part of the development of such capabilities; and affordability goals that the Air Force and the Navy (as the case may be) will be required to achieve during development, production, and sustainment activities for such capabilities that will not jeopardize or otherwise be detrimental to other high-priority future capabilities being developed and procured to support and execute other primary core competencies and missions. The Director of Cost Assessment and Program Evaluation shall submit to the congressional defense committees— a report on the results of the review conducted under subsection (c)(1)(A) with respect to the Air Force; and a report on the results of the review conducted under subsection (c)(1)(B) with respect to the Navy.
