Sec. 804. Modification of framework for modernizing acquisition processes to ensure integrity of industrial base

Section 2509 of title 10, United States Code, as added by section 845(a) of the National Defense Authorization Act for Fiscal Year 2020 ( Public Law 116–92 ), is amended— in subsection (b)(2)— in subparagraph (A)— by inserting , such as those identified through the Department of Defense’s supply chain risk management process and by the Federal Acquisition Security Council, and after supply chain risks ; and in clause (ii), by striking (other than optical transmission components) ; in subparagraph (C)— in clause (x), by striking ; and and inserting a semicolon; by redesignating clause
(xi)as clause (xii); and by inserting after clause
(x)the following new clause: processes and procedures related to supply chain risk management, including those implemented pursuant to section 806 of the Ike Skelton National Defense Authorization Act for Fiscal Year 2011 ( Public Law 111–383 ; 10 U.S.C. 2304 note); and ; and by adding at the end the following new subparagraph: Characterization and assessment of industrial base support policies, programs, and procedures, including— limitations and acquisition guidance relevant to the national technology and industrial base (as defined in section 2500(1) of this title); limitations and acquisition guidance relevant to section 2533a of this title; the Industrial Base Analysis and Sustainment program, including direct support and common design activities; the Small Business Innovation Research program; the Department of Defense Manufacturing Technology program; programs related to the Defense Production Act of 1950 ( 50 U.S.C. 4511 et seq.); the Trusted Capital Marketplace program; and programs in the military services. ; and in subsection (f)(2), by inserting , and supporting policies, procedures, and guidance after pursuant to subsection
(b).
