Section 2679 of title 10, United States Code, is amended— by redesignating subsections
(d)and
(e)as subsections
(e)and (f), respectively; and by inserting after subsection
(c)the following new subsection (d): With respect to a fiscal year in which cost savings are realized as a result of entering into an intergovernmental support agreement under this section for a military installation, the Secretary concerned shall make not less than 25 percent of the amount of such savings available for use by the commander of the installation solely for sustainment restoration and modernization requirements that have been approved by the major subordinate command or equivalent component. Not less frequently than annually, the Secretary concerned shall certify to the congressional defense committee the amount of the cost savings achieved, the source and type of intergovernmental support agreement that achieved the savings, and the manner in which those savings were deployed, disaggregated by installation. . The amendments made by this section shall apply with respect to fiscal year 2021 and each subsequent fiscal year.
