Sec. 301. Protection of offshore aquaculture facilities

The Secretary may promulgate regulations that the Secretary determines are reasonable and necessary to protect an offshore aquaculture facility. When appropriate, the Secretary shall request the Secretary of the department in which the Coast Guard is operating to establish a navigational safety zone around an offshore aquaculture facility. The Secretary of the department in which the Coast Guard is operating— shall consult with the Secretary of the Interior before designating a navigational safety zone around an offshore aquaculture facility; after consultation with the Secretary, the Secretary of State, and the Secretary of Defense, may designate a zone of appropriate size around (and including) an offshore aquaculture facility for the purpose of navigational safety; and may define, by regulation, permissible activities within a navigational safety zone.
No installation, structure, or use will be allowed in a navigational safety zone that is incompatible with the operation of the offshore aquaculture facility.
