Section 36 of the Mineral Leasing Act ( 30 U.S.C. 192 ) is amended by inserting , except that the Secretary may not demand such payment in oil or gas if the amount of such payment would exceed the amount necessary to fill the strategic petroleum reserve after in oil or gas . Section 27(a)(1) of the Outer Continental Shelf Lands Act ( 43 U.S.C. 1353(a) ) is amended by striking the period at the end and inserting , except that the Secretary may not demand such payment in oil or gas if the amount of such payment would exceed the amount necessary to fill the strategic petroleum reserve. .
