No funds in this or any other Act shall be used: to adjust apportionments or withhold funds from apportionments pursuant to 26 U.S.C. 9503(e)(4) ; to request or require any project to have a maximum Capital Investment Grant contribution lower than 50 percent of the total project cost; to determine a maximum Capital Investment Grant contribution for projects defined under 49 U.S.C. 5309(a)(2) or 49 U.S.C. 5309 (a)(5) until at least 180 days after a project has entered into the Engineering phase; and by the Federal Transit Administration when making a determination about whether a project sponsor’s cost estimate is reasonable, to require a probability higher than 50 percent that a project can be completed within that cost estimate: , That this proviso only applies to those applications that are in the “project development” phase as defined under subsections (d)(1), (e)(1), or (h)(2) of Provided 49 U.S.C. 5309 , or the “Engineering” phase as defined under subsections (d)(2) or (e)(2) of 49 U.S.C. 5309 on the date of enactment of this Act.
