Section 862 of National Defense Authorization Act for Fiscal Year 2012 ( Public Law 112–181 ; 125 Stat. 1521; 10 U.S.C. note prec. 2191) is amended— in subsection (a), in the matter preceding paragraph (1)— by striking Under Secretary of Defense for Acquisition, Technology, and Logistics and inserting Under Secretary of Defense for Research and Engineering ; and by striking ensure that Department of Defense contractors and inserting encourage Department of Defense contractors to ; and by amending subsection
(b)to read as follows: The cost of participating in activities described in subsection
(a)to a Department of Defense contractor shall be deemed to be an allowable cost under a contract between the contractor and the Department of Defense. . Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall issue such rules or guidance necessary to implement the amendments made by this section.
