Section 203 of the Child Abuse Prevention and Treatment Act ( 42 U.S.C. 5116b ) is amended— by striking subsection
(a)and inserting the following: For the purpose of making allotments to Indian tribes and tribal organizations and migrant programs, the Secretary shall reserve 5 percent of the amount appropriated under section 210(a) for each fiscal year, except that, if making such reservation would cause the total amount allotted to States under this section for a fiscal year to be less than such total for fiscal year 2019, the Secretary shall reserve 1 percent of the amount appropriated under section 210(a) for the year for such purpose. ; and by adding at the end the following: For any fiscal year for which the amount allotted to a State under subsection
(b)exceeds the amount allotted to the State under such subsection for fiscal year 2019, the State’s lead entity may use not more than 4 percent of such excess amount for administrative expenses. .
