Section 215 ( 33 U.S.C. 3005 ) is amended— by striking Effective October 1, 2009, the and inserting
(a); In general.— The by striking be increased from 321 to 379 if— and all that follows through fiscal year. and inserting not to exceed 500. ; and by adding at the end the following new subsection: Officers serving in positions designated under section 228 and officers recalled from retired status or detailed to an agency other than the Administration— may not be counted in determining the total number of authorized officers on the lineal list under this section; and may not count against such number. .
